We wish to inform you that Hotminds S.r.l., in its capacity as Data Controller (hereinafter, "Controller"), respects your privacy and considers the protection of personal data one of the primary objectives of its activities, complying with the provisions of European Regulation 2016/679 (GDPR) and applicable national legislation. 

This Privacy Policy, drafted pursuant to Article 13 of the GDPR, aims to explain in a simple and transparent manner which data are collected through this website (hereinafter, "Site") and for what purposes. Please note that the following information relates exclusively to the website www.hotminds.it and not to the website www.applied.it which you may consult during navigation; for the latter, we invite you to read the relevant Privacy and Cookie Policy found in the footer of each page. 

Finally, we intend to illustrate how you can effectively exercise your rights. 

 

1. Who processes your personal data? 

The Data Controller is Hotminds S.r.l., with registered office in Via Speranza, 35 – San Lazzaro (BO). The Controller has appointed a Data Protection Officer (DPO) who can be reached at the following e-mail address: dpo@agvisionhub.it. 

To obtain further clarification regarding processing activities, or to request assistance in exercising your personal data protection rights, you may contact the Controller at: privacy@hotminds.it. 

Furthermore, the personal data provided by you may be processed by the Controller’s employees and collaborators, who have been authorized and trained to ensure that processing is carried out in full compliance with the principles of lawfulness, fairness, transparency, purpose and storage limitation, data minimization, accuracy, integrity, and confidentiality. 

 

2. What data are processed? 

Before detailing the data processed through this Site, we wish to explain that, for the purposes of applicable law, "personal data" means any information relating to an identified or identifiable natural person ("data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural, or social identity. 

That being said, when you access and browse this Website, the following types of data are processed: 

Navigation Data 

The computer systems and software procedures used to operate this Site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users connecting to the Site, URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters relating to the user's operating system and computer environment. These data are used to obtain anonymous statistical information on the use of the Site and to check its correct functioning. However, such data could also be used to establish liability in the event of hypothetical computer crimes against the Site.  

Cookies and other tracking systems 

Cookies are small text files that websites visited by the user send and record on their computer or mobile device, to be retransmitted to the same sites upon the user's next visit. There are various types of cookies depending on their duration, characteristics, and functions. The Data Protection Authority has distinguished two macro-categories: 

  • Technical cookies: used solely for the purpose of "carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide such service" (Art. 122, paragraph 1 of Legislative Decree 196/2003). In other words, technical cookies are necessary for the correct functioning of the Site and allow you to access its features. They can be further divided into: 

         - navigation or session cookies, which ensure normal navigation and use of the Website; 

         - functionality cookies, which allow the user to browse based on a series of selected criteria (e.g., language) to improve the service provided.
            By virtue of their characteristics and functions, under applicable law, your prior consent is not required for the use of these technical cookies.
 

  • Statistical cookies: treated as technical cookies when used directly by the Site operator to collect information, in aggregate form, on the number of users and how they visit the Site. 

  • Profiling or marketing cookies: aimed at creating profiles related to the user and used to send advertising messages in line with the preferences expressed by the user while surfing the web. Unlike the above, the use of such cookies requires the user's prior consent. 

Specifically, we inform you that during Site navigation you will receive both technical cookies—aimed at facilitating your user experience and allowing the Controller to carry out statistical analysis in anonymous and aggregate form (consent not required)—and profiling cookies—aimed at presenting you with relevant and engaging advertisements. The installation of profiling cookies is subject to your prior consent given via the banner and can be managed by clicking on the appropriate icon on the Site, where you can, at any time, revoke any previously granted consent without affecting the ability to visit the site and use its contents. 

We also remind you that technical cookies are installed automatically upon accessing the Site or to activate certain features (e.g., language settings). However, you can always decide to disable them by changing your browser settings; in this case, you might experience some issues in browsing and using the Site. 

3. For what purposes are your personal data processed and for how long are they kept? 

  • To allow you to navigate the Site correctly and to properly enjoy its content. This processing is based on the legitimate interest of the Data Controller to ensure the functioning of the Site, duly balanced with the rights of the data subject (Art. 6, par. 1, letter f) of the GDPR). Personal data collected for this purpose are kept for seven days from the time of their processing, unless there is a need for the investigation of crimes by the Judicial Authority; 

  • To fulfill a legal obligation to which the Data Controller is subject (legal basis Art. 6, par. 1, letter c) of the GDPR). Personal data collected for this purpose are kept for seven days from the time of their processing, unless there is a need for investigation of crimes by the Judicial Authority; 

  • To present you with relevant and engaging advertisements. The legal basis for this processing is your consent (Art. 6, par. 1, letter a) of the GDPR). Regarding the deletion terms for personal data processed through cookies, you can find all the necessary information within the banner or by clicking on the specific icon on the Site. 

Please note that providing your personal data for the aforementioned purposes is optional; however, failure to provide it may, depending on the case, compromise correct navigation of the Site or prevent you from viewing personalized advertisements. 

Furthermore, we inform you that data processing is carried out mainly with automated tools for the time strictly necessary to achieve the purposes for which they were collected. Upon completion of processing, personal data are deleted immediately. 

 

4. With whom are your personal data shared? 

We inform you that the Data Controller, in the performance of its activities, may communicate your personal data to third parties duly authorized and/or appointed as Data Processors pursuant to Art. 28 of the GDPR. 

More specifically, these subjects may belong to the following categories: 

  • Subjects delegated and/or appointed by the Controller to carry out activities strictly related to the pursuit of the purposes referred to in point 3 of this Privacy Policy; 

  • Public bodies in compliance with laws, regulations, and applicable legislation. 

Furthermore, we inform you that your personal data are processed within the European Union. 

 

5. What are the rights you can exercise to protect your personal data? 

We inform you that, pursuant to and within the limits of Arts. 15-21 of the GDPR, you have the right, at any time, to: 

  • Request from the Data Controller access to, rectification, or erasure of your personal data; 

  • Request from the Data Controller the updating or integration of the data; 

  • Request from the Data Controller the transformation into anonymous form or the blocking of data processed in violation of the law, including those for which storage is not necessary in relation to the purposes for which the data were collected or subsequently processed; 

  • Request the restriction of processing concerning you or to object to their processing; 

  • Receive your personal data in a structured, commonly used, and machine-readable format and have the right to transmit those data to another controller without hindrance from the Data Controller to which they were provided, where the processing is based on consent or a contract and the processing is carried out by automated means; 

  • Withdraw consent to the processing of your personal data, without prejudice to the lawfulness of processing based on consent given before its withdrawal. 

Requests related to the points above must be addressed to the Data Controller at the following e-mail address: privacy@hotminds.it. 

We also remind you that you have the right to lodge a complaint with a supervisory authority (for example, the Italian Data Protection Authority - Garante per la protezione dei dati personali) if you believe that the processing of your personal data is contrary to the legislation in force. 

 

6. Changes to the Privacy Policy 

The information provided in this notice may be updated and/or modified over time, in relation to the processing activities carried out by the Controller or any regulatory changes. 

For this reason, we recommend that you periodically consult this Privacy and Cookie Policy, which is always kept up to date in this section.
